DMCA Policy for Mojave

Mojave respects the intellectual property rights of others and expects users of our product to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement committed using Mojave if such claims are reported to our Designated Copyright Agent, as described below.

Notification of Infringement

If you are a copyright owner, or authorized to act on behalf of one, and believe that your work has been copied in a way that constitutes copyright infringement, please provide our Copyright Agent with a written notice containing the following information:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

  • Identification of the copyrighted work claimed to have been infringed.

  • Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material.

  • Your contact information, including address, telephone number, and email address.

  • A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Response to Complaints

Upon receipt of a valid DMCA notice, Mojave will take appropriate action, which may include the removal or restriction of access to the allegedly infringing material. In accordance with the DMCA, we may also terminate accounts of repeat infringers when appropriate.

Counter-Notification

If you believe that your content was removed in error or misidentification, you may submit a counter-notification to our Copyright Agent that includes:

  • Your physical or electronic signature.

  • Identification of the material that has been removed or to which access has been disabled and the location where the material appeared before it was removed or access was disabled.

  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district, or if outside of the United States, that you consent to the jurisdiction of any judicial district in which Mojave may be found.

Repeat Infringers

Mojave may, in appropriate circumstances, disable or terminate the accounts of users who are repeat infringers of intellectual property rights.
